    • Personal data means any information about an individual from which that person can be identified.
    • We may collect, use store and transfer different kinds of personal data about you (depending on the context of your interactions with us) which we have grouped together as follows:
      • Identity Data includes first name, last name, username or similar identifier, date of birth and gender.
      • Contact Data includes email address, phone number, postal address, or billing address.
      • Financial Data includes bank account and payment card details.
      • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
      • Technical Data includes internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, or device ID.

      • Contact, Financial and Transaction Data is collected from providers of technical, payment and delivery services such as our third-party booking provider, The Only Way Togo Ltd.

      • Performance of a contract with you:Where we need to perform the contract we are about to enter into or have entered into with you, for example to answer your queries regarding our services, or keeping you up to date with important changes to our products or services. We  also process card payments through a third-party who only have access to the Information you provide directly to them when you make the card payment.
      • Legitimate interests: We may use your personal data where it is necessary to conduct our business and pursue our legitimate interests, for example to prevent fraud and enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
      • Legal obligation: We may use your personal data where it is necessary for compliance with a legal obligation that we are subject to. We will identify the relevant legal obligation when we rely on this legal basis.
      • Consent: We rely on consent only where we have obtained your active agreement to use your personal data for a specified purpose, for example emailing you about new services, offers or other information we think you may find interesting using the email address which you provided. You will be given an option to opt-out of these newsletters and have an option to unsubscribe at any time in the footer of each email. From time to time, we may also use your information to contact you for market research purposes.

    • When your personal data is collected, you will be asked to whether you would like to opt in to receiving direct marketing communications from us.
    • We would like to use your personal data to send you details of our products or services identified as likely to be of interest to you. We will only send you information in line with the venue and preferences you selected when you provided this personal data.
    • You may unsubscribe to our emails at any time through an unsubscribe option at the bottom of every email you receive from us.

    • In carrying out our business, including our obligations to you, we may share your information with other trusted third-party service providers, such as:
      • Internal third parties, including our affiliated businesses;

      • Email broadcasters, or marketing agencies;
      • Third parties to whom we may choose to sell, transfer or merge parts of our business or assets. Alternatively, we may seek to acquire other businesses or merge with them.     • Such providers are required under their data processing agreements with us, to handle your personal data in accordance with applicable laws and principles related to privacy and data protection.

We do not transfer your personal data outside the UK.

  1. DATA SECURITY
    • We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
    • In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
    • We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

  2. RETENTION PERIODS
    • We will keep your personal data for as long as is reasonably necessary for the purpose for which it was collected, as explained in this privacy policy. For example:
      • Gift cards; we will keep your personal data for 7 years after your last purchase. We need to retain this personal data for our own accounting and operational purposes and for legal and tax purposes.
      • Email marketing; we will keep this personal data for as long as we are able to market to you and if you withdraw your consent or opt-out of marketing communications, we will keep your contact details only to ensure that we do not contact you again for marketing purposes.
      • WiFi usage; we will remove your personal data after 1 year of inactivity.
      • Booking reservations; we will keep the personal data you have provided for 7 years after your booking date and we retain this data with permission to improve your service and experience with us.
      • Competition entries; we will only hold your personal data for as long as we need to run the competition and announce the winner/s unless otherwise stated that your email will be used for marketing purposes and you have opted into this.
      • Job applicants; we will retain your personal data for as long as we need to process your application and maintain application statistics and we will make this known to you.
      • We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
    • In certain circumstances, we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. If you have any questions with regards to what we hold please refer to the next section.

  3. DATA SUBJECT’S RIGHTS
    • You have rights in respect of your personal data we hold about you. We will need to confirm your identity before we can consider your request but details of these rights are set out below:
      • Right of access (commonly known as a “subject access request”). This enables you to receive a copy of the personal data we hold about you and to check we are lawfully processing it. We would need as much information as possible to enable us to locate your data.
      • Right to rectification. You have the right to have any incorrect personal data corrected or completed if it is incomplete. We will need as much information as possible to enable us to locate your data. We will look at any request and inform you of our decision within 28 days of receiving the request.
      • Right to erasure. This right, often referred to as the right to be forgotten allows you to ask us to erase personal data where there is no valid reason for us to keep it. We will look at any request and inform you of our decision within 28 days of receiving the request.
      • Right to object to processing where we are relying on a legitimate interest as our legal basis. You have the right to ask us to restrict processing of your data. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your right to object. We will look at any request and inform you of our decision within 28 days of receiving the request.
      • You have an absolute right to object at any time to the processing of your data for direct marketing purposes. See clause 5.3 for details of how to opt out of direct marketing. We will action your request as soon as possible.
      • Right to data portability. You have the right to move, copy or transfer your personal data from one IT environment to another. This right applies to data that you have provided to us and that we are processing on the legal basis of consent or in the performance of a contract and that processing is by automated means. We will respond to your request within 28 days of receipt of your request.
      • Rights relating to automated decision making/profiling. You have the right in respect of automated decision making, including profiling. Where we carry out solely automated decision making, including profiling, which has legal or similarly significant effects on you, we can only do this if it is in connection with a contract with you, we have a right under law or you have provided your explicit consent. We will tell you if this happens and tell you how you can request human intervention or challenge the decision.
      • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in one of the following scenarios:
        • If you want us to establish the data’s accuracy;
        • Where our use of the data is unlawful but you do not want us to erase it;

        • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
